Can the Court of Protection recommend a deputy?
Anyone with an understanding of a vulnerable person’s situation, who believes they may require some additional support, can recommend individuals who may be willing to take on the role of deputy. This could be anyone from the Court of Protection themselves to a social worker or carer.
The Court of Protection commonly deal with the search for deputies in the first instance. They will take all relevant information into account when making the decision, and may often consult those within the individual’s support network, such as family member or carer. Their overriding concern will always be the best interest of the person who is the subject of the proceedings. Therefore, the court will take the opinions of other relevant parties on board when considering people or professionals who can provide the service.
